Terms of service
1. All materials, including messages, and other communications, contained at nicky-star.com are not intended to be adult material and do not intentionally violate any community standards or any federal, state or local laws or regulations of the united states or any other country to the best of our knowledge, but persons under the age of 18 are cautioned to obtain parental permission first before viewing.

You hereby acknowledge:
that materials presented at and/or downloadable from nicky-star.com are the sole property of nicky-star.com.

You hereby further affirm and warrant that you are currently over the age of eighteen years and are capable of lawfully entering into this agreement.

2. Some or all of the following fees and charges may be incurred by the Subscriber:
a. Subscription Fees. Price are subject to change at any time and vary depending on which billing option is taken.
b. Other fees and/or charges for goods and services ordered at, through and/or from nicky-star.com and its licensees, either as special subscription options, downloadable materials, or mail-order items.

3. Subscriptions may not be assigned or transferred to any other person or entity. Subscriber must promptly inform nicky-star.com of apparent breaches of security, such as loss, theft, or unauthorized disclosure or use of an ID or password. Until nicky-star.com is notified, by conventional mail, electronic mail, or web site form, of a breach in security, the Subscriber will remain liable for any unauthorized use of nicky-star.com.

4. Subscription to nicky-star.com may be terminated at any time, and without cause, by either nicky-star.com or Subscriber upon notification of the other by electronic or conventional mail, or by telephone. Termination of access is effective 30 days from the most recent bill date, if the subscription is cancelled by the Subscriber; termination of access is immediate or if membership is revoked due to violation of this Agreement, or if the payment for subscription is denied by the billing processor, or if the initial payment is charged back. (There is no refunds.)

5. nicky-star.com does not fully screen all indirectly-linked websites accessible through link-lists on its Links page. Subscribers are therefore advised to use their own judgment to evaluate all third-party communications available indirectly through the use of nicky-star.com Links page, prior to purchasing goods and/or services, engaging in discussions, viewing content, or following hyperlinks to other websites. nicky-star.com is not liable for any promises, or products or services at any other website.

6. All materials included at nicky-star.com are for the private use by Subscribers only. No other uses are intended by nicky-star.com and any other use is strictly prohibited without express and advance written permission from nicky-star.com.

7. Subscriber agrees not to post any defamatory, deliberately inaccurate, abusive, threatening, offensive, or illegal material to the nicky-star.com forum. nicky-star.com, or in any communication to nicky-star.com in any format. Transmission of such material or any material that violates any federal, state, or local law in the United States or anywhere else in the world, is strictly prohibited and shall constitute a material breach of this Agreement entitling nicky-star.com to immediately terminate all rights to access to nicky-star.com. You agree that you have hereby been informed and noticed that any and all messages and other communications which you submit to nicky-star.com directly can be read by the operators and/or other agents of nicky-star.com, whether or not they are the intended recipient(s).

8. Updates to the members area will be decided by nicky-star.com, and there is no set day or time for updates. However nicky-star.com will try to update at least once a week. Also with any special updates this may be more then once a week. Update areas include, main gallery area, archive gallery area, vid&slide area, digital art area, Kool stuff area. Any one area or more that is updated will be considered an update.

9. At this time there is no instant subscriptions, once you join nicky-star.com a user name and password will be sent to your email within 12 hours. Depending on the time of day you could receive your login info within minutes. As we are notified as soon as your payment is made. But please remember if you join late at night we may not be on line. As soon as we come on line we will generate your login info, and get it sent to you.
Customers who sign-up, download and then ask for a refund, whether via charge back or cancelled check transactions, will be listed in our "dead beats" list, which may include publishing of name and other details pertaining to the individual.

Refund policy:
There will be no refund for termination of any membership due to violations of the terms of service. There will be no refunds for server hosting problems which may cause nicky-star.com to go down. (Note: If nicky-star.com should go down due to server problems for a day or longer, memberships will be adjusted to account for the lost time.)
nicky-star.com does not have a set time and days for updating the members area, this is totally up to nicky-star.com, there is no refund for any member who is unhappy with updates. (Please see updates in the TOS.)
If a member decides to terminate their membership there is no refund.
There is no refunds at nicky-star.com.
